TERMS AND CONDITIONS

1. Introduction

Welcome to Kozi Sports ("Kozi Sports," "we," "us," or "our"). Kozi Sports is an AI-powered sports prediction platform that provides users with machine learning-driven match predictions and AI-generated insights.

These Terms and Conditions ("Terms") govern your access to and use of the Kozi Sports platform, including our website, mobile application, and related services (collectively, the "Platform"). By registering, accessing, or using the Platform, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use the Platform.

2. Definitions

  • "Account" means the user account you create upon registration.
  • "AI Insights" means the artificial intelligence-generated analysis and commentary provided alongside certain predictions.
  • "Match Data" means the sports fixture information, statistics, and related data obtained from third-party API providers.
  • "Prediction" means the machine learning model-generated forecast for a sports match outcome.
  • "Subscription" means a recurring payment plan that provides access to the Platform's features.
  • "Tokens" means the virtual currency used on the Platform to access predictions.
  • "User" means any individual who registers and uses the Platform.

3. Eligibility

By using the Platform, you represent and warrant that:

  • You are at least 18 years of age.
  • You are legally capable of entering into binding contracts.
  • You will provide true, accurate, current, and complete registration information.
  • You will maintain and promptly update your registration information.

4. Account Registration and Security

  1. You must create an Account to access the Platform's features.
  2. You are solely responsible for maintaining the confidentiality of your Account credentials.
  3. You agree to notify us immediately of any unauthorized use of your Account.
  4. We reserve the right to suspend or terminate Accounts that violate these Terms.

5. Payments, Subscriptions, and Tokens

  1. Payment Processing: We use Paystack, a third-party payment processor, to handle all financial transactions. By making a payment, you agree to Paystack's terms and conditions and privacy policy.
  2. Tokens: Tokens are purchased using real currency and are used to access predictions on the Platform. Tokens have no cash value and are non-transferable.
  3. Subscriptions: We offer subscription plans that provide access to Platform features. Subscriptions automatically renew unless cancelled before the renewal date.
  4. Ledger: We maintain an internal ledger (Ledger-1st DB) that records all transactions, user data, and subscription details for operational and accounting purposes.
  5. No Withdrawals: Kozi Sports does not support the withdrawal of funds, tokens, or any form of monetary value from the Platform.

6. Refund Policy

  1. Eligibility for Refunds: Refunds are available only if the User has not initiated any prediction query or accessed any AI model on the Platform.
  2. Process: Refund requests must be submitted in writing to our support team within [X] days of purchase.
  3. Effect of Use: Once you begin querying the AI models or generating predictions, you forfeit your right to a refund.
  4. Subscription Refunds: For subscription plans, you are advised not to renew your subscription if you do not wish to continue. No pro-rata refunds are provided for partially used subscription periods.

7. Using the Platform

  1. Prediction Process:
    1. Purchase Tokens or subscribe to a plan.
    2. Select a country, league, and match.
    3. Choose a pre-trained Machine Learning model.
    4. The system generates a prediction.
    5. If the selected model supports AI Insights, prediction data (stripped of all user-identifying information) is sent to internally hosted AI models or external API providers (e.g., OpenRouter). Results are returned and displayed to you.
  2. Third-Party Services: We rely on third-party API providers for match data and certain AI services. Your use of these third-party services is subject to their respective terms and privacy policies.
  3. No Betting or Financial Advice: Predictions and AI Insights provided on the Platform are for entertainment and informational purposes only. They do not constitute financial, legal, or betting advice. Kozi Sports is not responsible for any decisions you make based on Platform content.

8. Referral System

  1. Kozi Sports may offer a referral program that rewards Users for referring new Users.
  2. Referral rewards are credited as Tokens or Platform credits and may only be used within the Platform.
  3. Referral rewards have no cash value and cannot be withdrawn or transferred.

9. Intellectual Property

  1. All content on the Platform, including but not limited to text, graphics, logos, software, and predictions, is the property of Kozi Sports or its licensors.
  2. You may not reproduce, distribute, modify, or create derivative works of any Platform content without our prior written consent.
  3. You retain ownership of any content you submit to the Platform, but grant us a worldwide, royalty-free license to use, store, and display such content as necessary to provide the Service.

10. User Conduct

You agree not to:

  • Use the Platform for any unlawful purpose.
  • Attempt to reverse engineer, decompile, or disassemble any part of the Platform.
  • Interfere with or disrupt the Platform's operation.
  • Use automated systems (bots, scrapers) to access the Platform.
  • Share your Account credentials with others.
  • Engage in any activity that could harm Kozi Sports' reputation or business.

11. Data Privacy

Our collection, use, and protection of your personal data are governed by our Privacy Policy, which is incorporated into these Terms. By using the Platform, you consent to the processing of your personal data as described in the Privacy Policy.

12. Disclaimer of Warranties

  1. The Platform and all content are provided "as is" and "as available" without warranties of any kind.
  2. We do not warrant that predictions will be accurate or that the Platform will be uninterrupted or error-free.
  3. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including implied warranties of merchantability and fitness for a particular purpose.

13. Limitation of Liability

  1. To the maximum extent permitted by applicable law, Kozi Sports shall not be liable for any indirect, incidental, special, consequential, or punitive damages.
  2. Our total liability to you for any claim arising out of or relating to these Terms or the Platform shall not exceed the total amount paid by you to us in the twelve (12) months preceding the claim.

14. Indemnification

You agree to indemnify and hold harmless Kozi Sports, its affiliates, officers, directors, employees, and agents from any claims, damages, losses, or expenses arising out of your use of the Platform or violation of these Terms.

15. Termination

  1. You may terminate your Account at any time by contacting our support team.
  2. We may suspend or terminate your Account immediately without notice if you breach these Terms.
  3. Upon termination, your right to use the Platform ceases immediately.
  4. Data Deletion: Upon termination or at your request, we will delete your personal data within thirty (30) days, in compliance with applicable data protection laws.

16. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Republic of Kenya. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of Kenya.

17. Changes to Terms

We reserve the right to modify these Terms at any time. Changes will be posted on the Platform with an updated effective date. Your continued use of the Platform after changes are posted constitutes your acceptance of the revised Terms.
